Applicability
The general terms and conditions of sale apply to all offers made by, orders placed with, deliveries made by and payments made to Madame Cocos. Deviation from these terms and conditions is only possible if this is done beforehand, in writing and explicitly on points, whereby the other provisions remain in full force. By accepting an offer or placing an order, the Madame Cocos customer accepts these conditions.

Offers and prices from Madame Cocos are non-binding. Madame Cocos accepts no liability for typographical or printing errors. Madame Cocos reserves the right to pass on changes in cost prices, exchange rates or (legal) regulations with immediate effect. All applicable prices are always inclusive of VAT and exclusive of order and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.

Orders
By placing an order, the agreement is a fact. Madame Cocos reserves the right to refuse orders without giving any reason, or to attach conditions to it.

Deliveries
Madame Cocos delivers once a week. Every Thursday we ship your order. If you order large quantities from production, your order will be delivered after production. Stated delivery times are only indicative. Exceeding any delivery time does not entitle the customer to compensation or the right to dissolve the agreement mentioned in article 3. All rights and claims, as stipulated in these terms and conditions, also apply to third parties engaged by Madame Cocos for the delivery.

Complaints
The customer is obliged to inspect the goods immediately after delivery. Complaints must be submitted to Madame Cocos in writing - or by e-mail - within one day after the time of delivery of the goods, under penalty of forfeiture of all rights, under the specified specification of the nature of the complaints with regard to the delivered goods. Shortcomings and visible defects on delivery, however, must be reported to Madame Cocos within 6 hours after delivery, under penalty of forfeiture of all rights resulting from this.

Payment
The customer meets with Madame Cocos the obligation, which arises from the agreement referred to under point orders, by means of prepayment through Ideal. In case Madame Cocos sends an invoice, the payment must be made within 8 calendar days, without settlement, discount and/or suspension. The date of payment is the date of crediting the bank account of Madame Cocos.

Complaints, warranty and return goods
The term for complaints regarding delivered goods is limited to the point under deliveries, 3rd paragraph. If it is shown that the products do not comply with the agreement, Madame Cocos has the choice to replace the products in question with new products or to refund the invoice value. The guarantee period for delivered products is the shelf life, which is guaranteed by Madame Cocos. Replacement shall take place free of charge within this period.

Transfer of risk and ownership
The risk of the delivered goods is transferred from Madame Cocos to the customer, as soon as the delivery has taken place. However, ownership shall not pass to the customer until the customer has fulfilled all his obligations referred to in the first paragraph of point of payment.

If the customer provides Madame Cocos with an address, Madame Cocos is entitled to send all orders to that address while retaining all rights as referred to in point of payment. Madame Cocos is entitled to use the e-mail address of the customer to send periodic newsletters and other automated and/or personal e-mails. The customer can cancel this membership at any time by unsubscribing in one of the e-mails.
